Terms and Conditions — Karina McIndoe Design

IMPORTANT NOTICE

By accepting these Terms and Conditions, you agree to be bound by them and confirm your authority to do so on behalf of any business you represent.

SITE USAGE

Karina McInode Design Studio (referred to as the "Design Studio") owns and operates the site. Your access to and use of the site must comply with these Terms and Conditions. The Design Studio may modify, suspend, or discontinue the site or its features without notice or liability. You are responsible for maintaining the equipment necessary to access the site. Service interruptions may occur due to maintenance, and the Design Studio will not be liable for these interruptions.

ACCOUNT CREATION

You must create an account to place orders. Provide accurate personal information, which the Design Studio will validate. The Design Studio reserves the right to refuse or terminate accounts at its discretion. Keep your passwords secure and notify the Design Studio of any unauthorized access.

ORDER PLACEMENT

Upon placing an order, you will receive an email acknowledging receipt, but this does not mean acceptance. You will be charged, and access rights to the designs will be granted once the order is accepted. The Design Studio may decline orders for various reasons, including legal issues. If declined, you will receive a full refund. An email will confirm the designs for which access rights are granted.

AMENDING OR CANCELLING ORDERS

Due to the automatic processing of orders, contact the Design Studio immediately if you wish to amend or cancel your order. The Design Studio will attempt to stop the order but cannot guarantee this.

DESIGN DESCRIPTIONS AND PRICING

Orders are accepted based on accurate design descriptions and pricing on the site. If an error in pricing is discovered, you will be informed and given the option to proceed or cancel the order. The Design Studio aims to display colors accurately but cannot guarantee that your monitor's display will match the actual colors.

Prices exclude VAT and other taxes, which you must pay. Payments must be made in full without deductions, in the currency specified on the site. Prices may change, but these changes will not affect already placed orders.

SALE CONTRACT

When a Sale Contract is created, you receive an exclusive, perpetual, worldwide, royalty-free license to:

Use, copy, and modify the design in any format.
Reproduce the design on products without quantity limits.
Sell products featuring the design.
Use the design in advertising or promotional materials for the products.

The Design Studio guarantees it owns the copyright to the designs, has not licensed it to a third party, and the designs are original. This warranty excludes elements in the public domain or licensed on a royalty-free basis. You are responsible for ensuring the designs comply with local laws and do not infringe trademarks.

Notify the Design Studio of any copyright infringement, claims, or other issues. The Design Studio will decide the appropriate action and handle all claims. You must not make any admissions and must assist the Design Studio as needed.

USER RESPONSIBILITIES

Use the site only as permitted by these Terms and Conditions and applicable laws. Do not use any design without granted access rights. The license use is subject to legal compliance, and you are solely responsible for this. Use designs for commercial purposes only and avoid any indecent, obscene, or unlawful usage.
